General terms and conditions
These general terms and conditions are an integral part of the agreement between you and ZERMATTHOMES ANTON LOCHMATTER AG. We suggest you to read carefully the following general terms and conditions.
2. Object of agreement
ZERMATTHOMES ANTON LOCHMATTER AG arranges holiday properties which are only in private hands. The control of the availabilities is managed by ZERMATTHOMES ANTON LOCHMATTER AG. Therefore we are usually able to inform you immediately if an object is available or occupied.
3. Reservation and conclusion of contract
When you sign the rental you are entering into a contract with ZERMATTHOMES ANTON LOCHMATTER AG. From the moment that the signed (both) contract is in the hands of ZERMATTHOMES ANTON LOCHMATTER AG the rights and obligations arising from the rental contract as well as the present contract terms, will be effective for you and for ZERMATTHOMES ANTON LOCHMATTER AG. If no deposit is paid within 10 days from contract signature, ZERMATTHOMES ANTON LOCHMATTER AG may dispose of the reserved property. In case of a payment not on the due date according to the regulation 4.4 ZERMATTHOMES ANTON LOCHMATTER AG may refuse to provide services.
4.1 Published Prices
Unless otherwise stated, the published prices are weekly rates for the whole property within the corresponding pricing period. Not included in the rental and payable on spot are additional services requested by the customer (e.g. baby bed, baby high chair, additional cleaning, firewood, additional bed linen, etc.). During winter season the minimum stay is usually 7 nights with arrival and departure on Saturday.
The total rental for the booked property is payable before the date of travel, as follows:
40% of the total rental for the reserved property is payable as a deposit within 10 days from the date of contract signature. The balance remaining must be paid to ZERMATTHOMES ANTON LOCHMATTER AG not later than 30 days before the start of the rental period. In case of last minute reservations from 30 days before the arrival the total rental is payable immediately at the time of booking and must be paid to ZERMATTHOMES ANTON LOCHMATTER AG. If the balance amount is not paid on time or the total rental in case of last minute bookings, ZERMATTHOMES ANTON LOCHMATTER AG may refuse to provide services.
4.3 Guarantee / Security deposit
A credit card (number, expiration date, security code) is required at the moment of booking. This is valid for guarantee and security deposit. ZERMATTHOMES ANTON LOCHMATTER AG reserves the right to block a security deposit at the arrival on the credit card.
4.4 Cancellation fees
If you withdraw from the contract, we will invoice you the following cancellation fees (incl. a non-refundable handling fee of CHF 100.—):
- up to 60 days before the start of the rental period: free of charge
- 59 to 30 days before the start of the rental period: 50% of the total rental
- 29 to 0 days before the start of the rental period / No Show 100% of the total rental
4.5 Price changes
Care has been taken in preparing the property descriptions and price calculations. Nevertheless, we cannot completely rule out the possibility of amendments to services or price changes. You will be notified of these at the time of booking and at the latest in the rental contract. Although changes to services after conclusion of the contract are unlikely, they cannot be completely ruled out. If there is a major change to a material point in the contract, you have the right to withdraw from the contract without charge within five days of receipt of the notification. Payments already made will be refunded without delay. We expressly reserve the right to effect price increases up to 22 days before the start of the rental period on the following reasons: raising or introduction of taxes and duties on specified services after conclusion of the contract.
5. Arrival and departure, contraction or extension of stay
The delivery of the keys is usually done at the office of ZERMATTHOMES ANTON LOCHMATTER AG. The arrival is between 4 pm and 6 pm, the departure before 9 am. If you should arrive after 6 pm, you have to inform us in advance (the address of the key holder will be provided then). If you are unable to take over the property as agreed, e.g. because of increased volume of traffic, strikes, etc., or for personal reasons, the rental will remain payable in full. The same will apply if you vacate the property earlier. If you would like to extend your stay, please contact us in time.
6. Change to services, alternative rental and cancellation of the contract by ZERMATTHOMES ANTON LOCHMATTER AG
ZERMATTHOMES ANTON LOCHMATTER AG has the right to rescind the contract before or during the rental period if unforeseeable or unavoidable circumstances make it impossible to hand over the rental property, endanger the hirer or the property or impair the provision of services to such an extent that it is no longer reasonable to fulfill the contract. Payments which are already done, will be refunded, deducting already provided services. ZERMATTHOMES ANTON LOCHMATTER is under no obligation to pay compensation in any of the instances referred to in point 6.
7. Duties of the lessee
The rental property must only be occupied by the specified number of persons (including children and infants). ZERMATTHOMES ANTON LOCHMATTER AG may refuse to accept additional persons or invoice them separately. In the event of over-occupancy ZERMATTHOMES ANTON LOCHMATTER AG is authorized to refuse to hand over the key and/or to immediately take the key back during the holiday. The rental property must be carefully looked after in use. Local house rules apply and consideration must be given in particular to neighbors (noise, behavior).. On departure day the bed linen must be taken off the beds, the kitchen cleaned (Cleaning of the kitchen furnishings, crockery and cutlery is the responsibility of the hirer and not included in the final cleaning), the refrigerator is empty und the waste is cleaned. If the hirer or co-users causes any damage this must be reported immediately to ZERMATTHOMES ANTON LOCHMATTER AG. The hirer is liable for any damage caused by him/her or co-users. The same applies if the apartment cannot be handed over to the next hirer. Any loss or damage may be charged with the security deposit (point 4.3)
8. Claims, claims for compensation
Should the condition of the property not be in accordance with the contract, or if you suffer any injury, this must be reported immediately to ZERMATTHOMES ANTON LOCHMATTER AG. If notification is not given immediately on commencement of the rental it will be assumed that the property is free of any defects. The same rules apply if any fault occurs during the rental period. ZERMATTHOMES ANTON LOCHMATTER AG is not authorized to recognize claims or to issue legally binding statements. Any claims must be notified in writing to ZERMATTHOMES ANTON LOCHMATTER AG within four weeks from the end of the contractual rental and the necessary evidence submitted (photographs, confirmation of ZERMATTHOMES ANTON LOCHMATTER AG, etc.). If you fail to comply with the above regulations and registration period you will forfeit all rights to compensation.
9. Liability of ZERMATTHOMES ANTON LOCHMATTER AG
9.1 In general
Should the rental property not be in accordance with the agreement, is ZERMATTHOMES ANTON LOCHMATTER AG anxious to find an equal alternative property. If this is not possible within an appropriate deadline or if you refuse the alternative object due to important objective reasons, ZERMATTHOMES ANTON LOCHMATTER AG refunds a possible lower value if ZERMATTHOMES ANTON LOCHMATTER AG is at fault. Statutory liability for loss or damage other than personal injury (e.g. damage to property or financial loss) is limited to the rental (with claims from all persons involved being counted together). If the services
of ZERMATTHOMES ANTON LOCHMATTER AG become subject to international conventions or national laws which further limit or exclude its liability, those conventions or laws will apply. ZERMATTHOMES ANTON LOCHMATTER AG will not be liable if the loss or damage is caused by any of the following:
- acts or omissions on your part, or on the part of a co-user
- unforeseeable or unavoidable omissions by third parties who are not involved in the provision of contractual services
- force majeure or events which ZERMATTHOMES ANTON LOCHMATTER AG, the intermediary or support personnel (e.g. keyholder) were unable to foresee or prevent despite exercising all due care
- use of swimming pools, children’s play areas, sports facilities of all kinds (such as tennis courts, football pitches, training facilities). The use of such facilities is at the participant’s own risk
- damage and losses resulting from theft or burglary.
We recommend that before commencing your journey you take out travel insurance and third-party insurance, unless you have already taken out appropriate insurance with adequate cover.
Compensation claims against ZERMATTHOMES ANTON LOCHMATTER AG, contractual rights reserved, expire by limitation after one year. The statutory period begins on the day following the end of the rental period.
12. Choice of law and place of jurisdiction
Visp is considered as legal domicile. Swiss law will prevail.
